Buying Property in Poland as a UK Citizen

Buying Property in Poland as a UK Citizen Migralegis.com.

Since Brexit, UK citizens are considered “third-country nationals” (from outside the EU/EEA). The rules for buying property in Poland as a UK Citizen depend on the type of property you wish to acquire.

1. When NO permit is required

You can buy property without any special permission from the authorities if it is:

  • A standalone apartment (flat) – Defined as an independent residential unit in a multi-unit building (including a cellar or a garage space).
  • Inheritance – If you are inheriting the property through legal succession.
  • Long-term residents – If you have lived in Poland for at least 5 years on a permanent residence or long-term EU residence permit.

2. When a permit (MSWiA) is required

You must obtain a permit from the Ministry of the Interior and Administration (MSWiA) if you want to buy:

  • A house – Even if it is for residential purposes, because buying a house involves purchasing the land it stands on.
  • Land – This includes building plots or agricultural land.
  • Property in a border zone – Any property located in a border area (even a flat) requires a permit for security reasons.

3. Conditions for obtaining a permit

To get the permit, you must:

  • Demonstrate ties to Poland – Examples include having a residence permit, being married to a Polish citizen, having Polish roots, or running a business in Poland.
  • Pass a security check – The Ministry ensures the purchase does not pose a threat to national security.
  • Pay a fee – The application fee is approximately 1,570 PLN, and the process usually takes 2 to 6 months.

  • Check the Land Registry: Before signing any preliminary contract or paying a deposit, verify the legal status of the property.
  • The “Promesa”: You can apply for a “Promise” (promesa) of a permit. It is valid for one year and gives you a guarantee that you will receive the actual permit once you find the specific property.
  • Notary: All real estate transfers in Poland must be done in the form of a Notary Deed.
